Highlights: PA PUC Public Session of October 11, 2012

          At the October 11, 2012, Public Meeting of the Pennsylvania Public Utility Commission (“Commission”), the Commissioners adopted Staff’s recommendations for action by a vote of 5-0 on all items listed on the Main Agenda and Carry-In Agenda, except as reflected herein below under the respective Commission agenda headings.  Review of particular items addressed by the Commissioners at this Public Meeting which may be of interest are addressed under the respective Commission agenda headings below.  Any relevant motions and statements are attached hereto and to the original of this Session Memo filed in the Public Meeting Agenda and Session Memo binder.  The next regular Public Meeting is tentatively scheduled for October 24 at 10:00 a.m.  The minutes of the Public Meeting of September 13, 2012, were, by a vote of 5-0, approved without modification.

MAIN AGENDA

BUREAU OF TECHNICAL UTILITY SERVICES (Transportation)

  • Select Ambulance, 2272302-TAS, A-2011-2272302.  Application for the right to begin to transport as a common carrier by motor vehicle, persons in paratransit service.  RECOMMENDATION:  That the Commission adopt the proposed Order approving the application, as amended.  Vote 5-0.
  • E&E Consulting LLC T/A E&E Transport, 2285526-TAS, A-2012-2285526.  Application for the right to begin to transport as a common carrier by motor vehicle, persons in paratransit service.  RECOMMENDATION:  That the Commission adopt the proposed Order approving the application, as amended.  Vote 5-0.

BUREAU OF AUDITS

  • Metropolitan Edison Company, 2308656-AUD, D-2012-2308656.  Non-Utility Generation Charge.  RECOMMENDATION:  That the Commission approve the release of Met-Ed's Non-Utility Generation Charge Audit Report for Sixteen Months Ended April 30, 2012.  Vote 5-0.
  • Pennsylvania Electric Company, 2308657-AUD, D-2012-2308657.  Non-Utility Generation Charge.  RECOMMENDATION:  That the Commission approve the release of Penelec's Non-Utility Generation Charge Audit Report for Sixteen Months Ended April 30, 2012.  Vote 5-0.

OFFICE OF SPECIAL ASSISTANTS

  • Clean Treatment Sewage Company, 2109324-OSA, I-2009-2109324.  By Order entered 5/25/12, the Commission directed PAWC to acquire the wastewater system of Clean Treatment Sewage Company through the eminent domain process. The Commission also directed PAWC to file a Plan for Improvements within sixty days.  PAWC filed a “Preliminary Plan for Improvements” on 7/24/12, in which it requested certain information from CTSC as well as additional time to submit its final Plan for Improvements. Several Parties filed Comments on the Preliminary Plan.  RECOMMENDATION:  That the Commission adopt the proposed Opinion and Order.  Vote 5-0.
  • Peregrine Keystone Gas Pipeline LLC, 2200201-OSA, A-2010-2200201.  Application filed on 9/17/10. In a Recommended Decision, issued 5/23/12, ALJ Colwell recommended that the Application be denied. Peregrine filed a Petition to Withdraw Application on 6/8/12. By Order entered 9/13/12, the Commission granted Peregrine’s Petition to Withdraw Application and vacated the Recommended Decision. On 9/28/12, the Pennsylvania Independent Oil and Gas Association filed a Petition for Reconsideration of the 9/13/12 Order.  RECOMMENDATION:  That the Commission adopt the proposed Opinion and Order which grants the Petition for Reconsideration, pending further review of, and consideration on, the merits.  Vote 5-0.
  • Bureau of Transportation & Safety vs. Madalyn Maty Ciabationi t/a Reading Express Airport Shuttle, 2248188-OSA, C-2011-2248188.  Complaint instituted on 6/30/11, alleging that failure to maintain evidence of insurance on file with the Commission. Petitioner did not file an answer to the Complaint. By Secretarial Letter issued 11/2/11, the Commission sustained the Complaint and cancelled Petitioner's Certificate of Public Convenience. On 4/9/12, the Petitioner filed a Petition requesting reinstatement of the Certificate and waiver of the civil penalty. By Order of 6/21/12, the Commission notified Petitioner that it would not grant the request for waiver of the civil penalty, but that Petitioner could re-file for reinstatement when the civil penalty was satisfied. On 8/16/12, Petitioner filed the instant Petition for Reinstatment.  RECOMMENDATION:  That the Commission adopt the propose Opinion and Order that grants the Petitions, subject to a condition.  The matter has been postponed to the 10/24/12 Public Meeting.
  • New Cingular Wireless And Consolidated Communications of Pa, 2319945-OSA, A-2012-2319945, A-310518F7005.  Joint Petition filed on 8/15/12, seeking approval of an Amendment to a Commercial Mobile Radio Service Agreement pursuant to Section 252(e) of the Telecommunications Act of 1996. Notice was published in the PA Bulletin. No comments or protests were received.  RECOMMENDATION:   That the Commission adopt the proposed Opinion and Order which grants the Joint Petition.  Vote 5-0.

BUREAU OF TECHNICAL UTILITY SERVICES

  • IDT Energy Inc., 2119279-FUS, A-2009-2119279.  The matter was postponed from the 09/13/12 Public Meeting.  Amended Application filed on 5/15/12, to offer, render, furnish, or supply natural gas supply services to residential, small commercial (less than 6,000 MCF annually), and large commercial (6,000 MCF or more annually) customers in the additional service territories of Columbia Gas and UGI Utilities within PA, as a supplier of natural gas services and a broker/marketer engaged in the business of supplying natural gas services.  RECOMMENDATION:  That the Commission adopt the proposed Order which approves the application amendment.  The matter has been postponed to the 10/24/12 Public Meeting.
  • Pennsylvania Electric Co., 2314231-FUS, S-2012-2314231.  Securities certificate filed on 7/10/12, with respect to the issuance of debt in a principal amount not to exceed $395 million. No protests were filed and no hearings were held. On several occasions Penelec voluntarily extended the consideration period. the latest being until 10/12/12.  RECOMMENDATION:  The Commission register the securities certificate consistent with the proposed Order.  Commissioner Gardner’s Dissenting Statement is attached.  Oral Statement made by Chairman Powelson (not attached).  Vote 4-1.

  • All matters approved as submitted.

OFFICE OF ADMINISTRATIVE LAW JUDE

  • Metropolitan Edison Co, 2303491-ALJ, M-2012-2303491.  Default Service Support Charge Reconciliation for the 15 months ended 3/31/12.  COMMISSION REVIEW:  That the Commission adopt ALJ Colwell's Recommended Decision accepting the filing, insofar as they are unopposed.  Vote 5-0.
  • Pennsylvania Electric Co, 2303492-ALJ, M-2012-2303492Default Service Support Charge Section 1307(e) Reconciliation Statement for the 15 months ended 3/31/12.  COMMISSION REVIEW: That the Commission adopt ALJ Colwell's Recommended Decision accepting the filing, insofar as they are unopposed.  Vote 5-0.

CARRY-IN AGENDA

OFFICE OF SPECIAL ASSISTANTS

  • Met-Ed, Penelec, Penn Power & West Penn, 2273650-OSA, P-2011-2273650, P-2011-2273668, P-2011-2273669, P-2011-2273670.  By Order entered 8/16/12, the Commission, inter alia, granted, in part, the Companies’ Joint Petition for approval of their DSP. On 8/31/12, the following six Parties each filed Petitions for clarification, rehearing and/or reconsideration (Petitions): (1) the Coalition for Affordable Utility Services and Energy Efficiency in Pennsylvania; (2) the Constellation Energy Commodities Group, Inc., Constellation NewEnergy, Inc., Exelon Generation Company, LLC, and Exelon Energy Company; (3) the Companies; (4) the Office of Consumer Advocate; (5) the Office of Small Business Advocate; and (6) the Retail Energy Supply Association. On 9/10/12, six of the Parties filed Answers to the Petitions, including Dominion Retail, Inc., Met-Ed Industrial Users Group, Penelec Industrial Customer Alliance, Penn Power Users Group, West Penn Power Industrial Intervenors, and Washington Gas Energy Services, Inc. On 9/27/12, the Commission entered an Opinion and Order that addressed the Petitions on the merits.  RECOMMENDATION:  That the Commission adopt the proposed Amended Opinion and Order that revises the 9/27/12 Order to reflect the Answer of Dominion Retail, Inc. Vote 5-0.

ANNOUNCEMENTS

  • A special tribute and remembrance of former Commissioner Bill Shane was held prior to meeting.
  • A special observance celebrating the PUC’s 75th Anniversary will be held on 10/24 after public meeting.
