Highlights: PA PUC Public Session of March 17, 2016

          At the March 17, 2016 Public Meeting of the Pennsylvania Public Utility Commission ("Commission"), the Commissioners adopted Staff's recommendations for action by a vote of 5-0 on all items listed on the Main Agenda and Carry-In Agenda, except as reflected herein below under the respective Commission agenda headings.  Review of particular items addressed by the Commissioners at this Public Meeting which may be of interest are addressed under the respective Commission agenda headings below.  Any relevant motions and statements are attached hereto and to the original of this Session Memo filed in the Public Meeting Agenda and Session Memo binder.  The next regular Public Meeting is tentatively scheduled for April 7, 2016 at 10:00 a.m.  The minutes of the Public Meeting of the February 25, 2016, were, by a vote of 5-0, approved as submitted.

MAIN AGENDA

BUREAU OF AUDITS

  • All matters approved as submitted.  

OFFICE OF SPECIAL ASSISTANTS

  • MARY PAUL VS PECO ENERGY COMPANY, C-2015-2475355.  Formal Complaint filed on 4/01/15, alleging that PECO was threatening to terminate her service for failure to provide PECO with access to her meter so that a smart meter could be installed.  On 4/27/15, PECO filed an Answer with New Matter, as well as Preliminary Objections, seeking dismissal of the Complaint for legal insufficiency.  On 7/01/15, the Commission issued ALJ Cheskis' Initial Decision which granted PECO's Preliminary Objections and dismissed the Complaint.  On 7/21/15, the Complainant filed Exceptions.  On 8/03/15, PECO filed Replies to Exceptions.  RECOMMENDATION: That the Commission adopt the proposed Opinion and Order.  Statement by Commissioner Witmer.  Vote 4-1 with Commissioner Witmer dissenting.
  • SPRAGUE OPERATING RESOURCES LLC, M-2015-2490383, A-2015-2494779, A-2015-2292048.  On 7/8/15, the Commission adopted a Tentative Order proposing to cancel the license of certain Electric Generation Suppliers (EGSs), including Sprague Operating Resources for not filing the required financial security documentation to maintain their EGS licenses.  On 7/17/15, Sprague filed an Application to Abandon indicating its intention to abandon its PA EGS license.  A Final Order cancelling the EGSs' licenses was entered on 8/28/15.  On 9/10/15, Sprague filed a Petition for Reconsideration to the Final Order.  No Answers to the Petition have been filed.  RECOMMENDATION:  That the Commission adopt the proposed Opinion and Order denying the Petition for Reconsideration and finding moot the Application to Abandon.  The matter has been postponed until the Public Meeting of April 7, 2016. 

BUREAU OF TECHNICAL UTILITY SERVICES

  • FRONTIER COMMUNICATIONS OF BREEZEWOOD LLC, CANTON LLC, LAKEWOOD LLC, OSWAYO RIVER LLC, AND PENNSYLVANIA LLC, R-2016-2524540, P-00951005F1000.  2016 Joint Price Stability Index/Service Price Index Report Filing and accompanying tariff supplements requesting an aggregate rate increase of $45,565.00 filed on 2/1/16.  No protests were filed and no hearings were held.  RECOMMENDATION:  That the Commission adopt the proposed Order.  Matter withdrawn by the Bureau of Technical Utility Services. 
  • COMMONWEALTH TELEPHONE COMPANY D/B/A FRONTIER COMMUNICATIONS COMMONWEALTH TELEPHONE COMPANY, R-2016-2524592, P-00961024F1000.  2016 Price Stability Index/Service Price Index Report Filing and accompanying tariff supplement requesting a rate increase of $396,474 filed on 2/1/16.  No protests were filed and no hearings were held.  RECOMMENDATION:  That the Commission adopt the proposed Order.  Matter withdrawn by the Bureau of Technical Utility Services.

  • All matters approved as submitted. 

CARRY-IN AGENDA

BUREAU OF TECHNICAL UTILITY SERVICES

  • VERIZON PENNSYLVANIA LLC, R-2016-2526640, C-2016-2533473.  On 1/29/16, Verizon filed a tariff revision to Local General Tariff - Pa P.U.C. No. 1, proposing to add an Individual Case Basis provision for certain business customers, where the rates and charges are based on the customer's specific circumstances, to become effective 2/28/16, and further extended to 3/29/16.  RECOMMENDATION: That the Commission adopt the proposed Order.  Matter withdrawn by the Bureau of Technical Utility Services.

NEXT PUBLIC MEETING IS TENTATIVELY SCHEDULED FOR THURSDAY, APRIL 7, 2016 AT 10:00 A.M.
