BankruptcyThomas, Niesen & Thomas’s Bankruptcy practice group provides trustees, creditors’ committees, debtors and creditors with representation in all Chapters under the Bankruptcy Code throughout Pennsylvania. Our attorneys focus on creative, practical approaches and realistic solutions to achieve our clients’ objectives in a timely and cost-effective manner.

We counsel and assist clients on all aspects of bankruptcy, reorganization, debtor-creditor rights, and out of court workouts in the Bankruptcy Courts and Appellate level courts. Our Bankruptcy practice group provides services in connection with virtually every type of bankruptcy dispute, including:

  • Trustees: Recovery of assets, preferential transfer and fraudulent transfer litigation.
  • Debtors-In-Possession: Formulating plans of reorganizations and good faith sales free and clear of liens.
  • Committees: Monitoring Debtor-In-Possession activities and negotiating plans of reorganization.
  • Creditors: Automatic stay litigation, filing proofs of claims and involuntary petitions.
  • Debtors: Filing Chapter 7, Chapter 11, Chapter 12, and Chapter 13 petitions, personal and business reorganizations, and family farmer plans.

Our Bankruptcy attorneys are thoroughly familiar with the Federal Bankruptcy Code and other pertinent bankruptcy laws, including the Uniform Fraudulent Conveyances Act and Article 9 of the Uniform Commercial Code, and understand the application and interplay of State law with these bankruptcy laws.  Our attorneys are also well-versed in the changes to and reforms in the bankruptcy laws as a result of the Bankruptcy Abuse Prevention and Consumer Protection Act (BAPCPA), enacted by Congress in April 2005.
